This option determines the appropriate estate planning documents to be prepared:
An "Individual Estate Plan" is prepared for an unmarried (i.e., single, divorced or widowed) or a married user. If you are married, there will be options asked concerning the status of the marriage and any distributions desired for the spouse.
For the "Joint Estate Plan for a Married Couple", the couple must be legally married and must be a man and a woman. Based on your answers to upcoming questions, the program will automatically determine the best and most appropriate type of joint trust for you; you do not need to worry about what is the right type of trust, the software has an exclusive "matrix" which makes this decision for you.
The "Non-Traditional Couple Joint Estate Plan" is designed for two people (other than a married man and woman) who desire to hold their assets in a joint trust, wish to first benefit the survivor and have the same desire for the ultimate distribution of the trust; for all other arrangements, the partners must each use the "Individual" option. Based on your answers to upcoming questions, the program will automatically determine the best and most appropriate type of joint trust for you; you do not need to worry about what is the right type of trust, the software has an exclusive "matrix" which makes this decision for you. The software has been updated for the US Supreme Court decision in US vs. Windsor. Please note that there is no Federal Marital Deduction for an unmarried couple (whether same sex or man and woman); however, with the properly structured trust, the couple can still "double" the amount which can pass estate tax free.
Select which type of estate planning "package" you desire; both "packages" will include the appropriate supporting documents (e.g., powers of attorney, health care powers, "living wills", burial instructions, etc.)
A Revocable Living Trust package features a trust agreement which is funded during your lifetime and which avoids a court supervised probate on the assets in the trust at your death and/or avoids a court supervised conservatorship on the assets in the trust in the event of your incapacity. This package includes the "pour-over Will", Certification of the Trust and the necessary transfer documents.
The Will package features a "stand-alone" Will which can, if you choose, hold assets of your estate in trust for your beneficiaries (this trust is not created until after your death). Unlike a living trust, no change in the title to your assets is necessary now, but the assets in your estate may have to go through a probate at your death.
NOTE: for a married couple, the same estate tax benefits can be achieved with either package.
